Terms of Service

These Terms of Service ("Terms") govern access to and use of FillFast ("FillFast", "we", "us", or "our"), a fuel station management platform that includes an Organization Portal for fuel station owners and administrators and a Station Portalfor station employees (together, the "Service"). By creating an account, logging in, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Acceptance of Terms
These Terms form a legally binding agreement between you and FillFast. If you are accepting these Terms on behalf of a business, organization, or fuel station (an "Organization"), you represent that you have the authority to bind that Organization, and "you" refers to both you and the Organization.
If you are an employee added to the Service by an Organization (through the Station Portal), your use of the Service is also governed by these Terms and by any additional policies your employer applies to your employment or engagement.
2. Description of Service
FillFast India provides a software-as-a-service platform for managing fuel station operations, including fuel inventory and tank/pump readings, sales and transaction recording, expense and purchase tracking, employee shift and attendance management, payroll processing, approvals, reconciliation, and related reporting and analytics. Features available to a given account depend on the account's role and the Organization's subscription plan.
3. Account Types & Eligibility
The Service is accessed through distinct account types:
- Organization Owner / Admin accounts — created during signup and onboarding by a person authorized to act on behalf of a fuel station business. These accounts can configure the Organization, add stations, invite or create employee accounts, manage subscriptions and billing, and access consolidated financial and operational data.
- Station Portal / Employee accounts— created by an Organization Owner or Admin for individual employees (e.g., station managers, cashiers, pump operators). These accounts are typically provided a system-generated employee ID and temporary password, and access is limited to the functions and data assigned to that employee's role.
- Super Admin accounts — used internally by FillFast to operate, support, and maintain the platform.
You must be at least 18 years old and legally capable of entering into a binding contract under Indian law (including the Indian Contract Act, 1872) to create an Organization account. Employee accounts must belong to individuals who are lawfully employed or engaged by the Organization.
4. Registration & Security
You agree to provide accurate, current, and complete information during registration and onboarding (including business details such as GSTIN, PAN, and business registration/license numbers where applicable) and to keep this information up to date.
You are responsible for maintaining the confidentiality of your login credentials (including employee usernames and temporary passwords) and for all activity that occurs under your account. You must notify us promptly at support@fillfast.in if you suspect unauthorized access to your account. We are not liable for losses arising from unauthorized use of an account caused by your failure to safeguard credentials.
Employees issued a temporary password may be required to change it before continuing to use the Service.
5. Organization Responsibilities
As the party that creates and manages employee accounts, an Organization is responsible for:
- Ensuring it has the legal right and, where required by applicable law, the consent of each employee to input, store, and process that employee's personal data (including identity documents, bank details, and salary information) on the Service.
- Informing its employees of how their data will be used within the Service, including attendance location tracking and payroll processing.
- Promptly removing or deactivating accounts of employees who leave or whose access should no longer continue.
- The accuracy of business, tax, financial, and payroll data entered into the Service, and for compliance with applicable labour, tax, and payroll laws (e.g., PF, ESI, and income tax withholding).
- All actions taken using Organization Owner, Admin, or Employee credentials associated with its account.
FillFast acts as a service provider that processes data on the Organization's behalf and instructions in connection with the Service, as further described in our Privacy Policy.
6. Employee / Station Portal Use
Station Portal access is provided to employees solely for performing their job duties, such as recording shifts and attendance, entering fuel transactions and readings, and viewing their own payroll and shift information. Employees must not:
- Share their login credentials with, or allow use of their account by, any other person.
- Attempt to access data, stations, or features outside their assigned role or permissions.
- Falsify attendance, transaction, inventory, or expense records.
Location data may be captured when an employee clocks in or out through the Station Portal, for the purpose of verifying attendance at the assigned station. See our Privacy Policy for details.
7. Subscription, Fees & Billing
Access to the Organization Portal is provided under a subscription plan selected during onboarding. Fees, billing cycle, and included usage limits are as described in the plan selected and any applicable order form or invoice. Unless stated otherwise:
- Subscription fees are billed in advance and are exclusive of applicable taxes (including GST), which will be added to invoices as required by law.
- Fees are non-refundable except where required by law or expressly stated at the time of purchase.
- We may suspend access for accounts with overdue payments after providing reasonable notice.
- We may change subscription pricing for future billing cycles with prior notice; continued use after a price change takes effect constitutes acceptance.
Employee/Station Portal accounts created by an Organization do not carry a separate fee; they are provisioned under the Organization's subscription.
8. Acceptable Use
You agree not to, and not to permit any user of your account to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload or input data that infringes third-party rights, is fraudulent, or that you do not have the right to submit.
- Attempt to gain unauthorized access to the Service, other accounts, or underlying systems and networks.
- Reverse engineer, decompile, or attempt to extract source code from the Service, except where permitted by law.
- Interfere with or disrupt the integrity or performance of the Service, or introduce malware.
- Use automated means (scraping, bots) to access the Service without our prior written consent.
- Resell, sublicense, or provide access to the Service to any third party not authorized under these Terms.
9. Data & Content Ownership
As between FillFast and an Organization, the Organization retains all rights to the business, transaction, employee, and other data it or its employees submit to the Service ("Customer Data"). We are granted a limited license to host, process, and use Customer Data solely to provide, maintain, secure, and improve the Service, and as otherwise described in our Privacy Policy.
On termination of a subscription, we will make Customer Data available for export for a reasonable period as described in Section 17, after which it may be deleted in accordance with our data retention practices.
10. Third-Party Services
The Service may allow sign-in via third-party identity providers (e.g., Google, Microsoft) or integrate with third-party services such as payment processors, SMS/email providers, and cloud hosting providers. Your use of any third-party service is subject to that provider's own terms and privacy policy, and we are not responsible for third-party services we do not control.
11. Intellectual Property
The Service, including its software, design, text, graphics, logos (including the FillFast name and marks), and underlying technology, is owned by FillFast India or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you in the Service or its content.
12. Service Availability
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform scheduled or emergency maintenance, and functionality may change over time as we improve the Service. Where a specific uptime commitment applies, it will be set out in a separate service-level agreement.
13. Confidentiality
Each party agrees to protect the other party's confidential information disclosed in connection with the Service using at least the same degree of care it uses to protect its own confidential information of similar nature, and not less than reasonable care, and to use such information only as necessary to perform its obligations or exercise its rights under these Terms.
14. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, FillFast disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. FillFast does not warrant that the Service will meet all of your requirements or be error-free.
The Service assists with record-keeping, reporting, and workflow for fuel station operations but does not constitute legal, tax, accounting, or compliance advice. You remain responsible for verifying figures used for statutory filings and compliance.
15. Limitation of Liability
To the maximum extent permitted by applicable law, FillFast shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, FillFast India's aggregate liability arising out of or relating to these Terms or the Service shall not exceed the amount actually paid by the Organization to FillFast for the Service in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be limited or excluded under applicable law.
16. Indemnification
You agree to indemnify and hold FillFast harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) Customer Data submitted through your account, including employee personal data submitted without proper authorization or consent; or (c) your violation of applicable law or third-party rights.
17. Suspension & Termination
You may terminate your Organization's subscription at any time in accordance with the cancellation process made available in the Service or by contacting us. We may suspend or terminate access to the Service, in whole or in part:
- For material breach of these Terms that is not cured within a reasonable period after notice;
- For non-payment of applicable fees;
- Where required to comply with applicable law or a valid order of a court or government authority;
- To prevent harm to the Service, other users, or third parties (e.g., suspected fraud or security threats).
Upon termination, an Organization's right to access the Service ends, and associated employee accounts will lose access. We will retain Customer Data for a reasonable export period thereafter, subject to our data retention and deletion practices described in the Privacy Policy.
18. Governing Law & Disputes
These Terms are governed by the laws of India, without regard to conflict of law principles. Subject to any mandatory consumer protection or employment law rights that cannot be waived, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
The parties will first attempt to resolve any dispute through good faith negotiation. If unresolved within thirty (30) days, either party may pursue resolution through the courts identified above, or, where the parties agree in writing, through arbitration under the Arbitration and Conciliation Act, 1996.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service or legal requirements. If we make material changes, we will provide reasonable notice (for example, by posting an updated "Last updated" date, by in-app notice, or by email to Organization Owners/Admins). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
